Permit Holder Guideline #22
PERMIT TITLE: Hazardous Materials
CODE SECTION (2003 Virginia Statewide Fire Prevention Code): 2701.5
SCOPE: The provisions of this chapter shall apply to all conditions related to storage, dispensing, use and handling of all hazardous materials. Where specific conditions exist in other chapters, those requirements shall apply.

PERMIT EXPIRATION: ONE (1) year from date issued
REQUIREMENTS: Permit holder agrees to abide by the Virginia Statewide Fire Prevention Code and any special stipulations noted on permit, as well as the following:
1. Permit Holder shall be in possession of a Hazardous Materials Inventory Statement for materials used and or stored.
2. When required, Permit Holder shall develop a Hazardous Materials Plan in accordance with section 2701.5.1 of the Virginia Statewide Fire Prevention Code.
3. Maximum allowable quantities per control area shall be in accordance with Table 2703.1.1 (1) through 2703.1.1(4).
4. Materials shall be properly stored and marked using the NFPA 704 system.
5. No Smoking Signs shall be posted in accordance with 2703.7.1
6. Detached storage of hazardous materials shall be in accordance with 2703.8.2 of the Statewide Fire Prevention Code.
7. Exhausted enclosures where flammable materials are stored shall be equipped with an approved Automatic Fire Extinguishing System.
8. Separation of incompatible materials shall be in accordance with section 2703.9.8.
9. Spill Control for Hazardous Materials shall be in accordance with section 2704.2.1.
10. Material Safety Data Sheets (MSDS) shall be readily available on the premises for material regulated by this chapter.
11. Hazardous Materials in any quantity shall not be released into any sewer, storm drain, ditch, drainage canal, stream, river, lake or tidal waterway and on the ground, sidewalk, street, and highway or into the atmosphere.
12. Personnel responsible for the operation of areas where hazardous materials are used or stored shall be familiar with the chemical nature and the appropriate mitigating actions in the event of a leak, spill or fire in accordance with section 2703.9.1.
